YouTube Smacks Down The Ninja with update
Last week YouTube.com got the smack down from NBC for hosting the Lazy Sunday sketch from SNL.
Today AskANinja.com got these emails from YouTube:
Not to worry, we're already in the works on building a site to host our own Flash files, but if the content creators can't post their files at YouTube, and copyright violators can't either, who is going to be allowed to post their videos?
So They took down episodes 8, 9, 10. As a form of protest -- what's say everyone uploads their own copy of those episodes to YouTube? Put the links to your copies in comments.
UPDATE:
The videos are back online. Read more here.
Today AskANinja.com got these emails from YouTube:
Followed by:Your video Ask A Ninja: Question 10 "Ninja Metal" has been rejected due to its inappropriate nature. Please refer to our terms and conditions for more information on what video material is not permitted on YouTube.
Dear Subscriber:A couple of things, we are the creators of the Ask A Ninja, we were (and still are) using their site to host the Flash Video versions of our work. It's odd that we can just be arbitrarily cut off from our audience of over 280,000 viewers on the YouTube.com site.
This is to notify you that we have removed or disabled access to on or
more of your videos as a result of a third-party notification claiming
that this material is infringing.
If you elect to send us a counter notice, to be effective it must be a
written communication provided to our designated agent that includes
substantially the following (please consult your legal counsel or see 17
U.S.C. Section 512(g)(3) to confirm these requirements):
(A) A physical or electronic signature of the subscriber.
(B) Identification of the material that has been removed or to which
access has been disabled and the location at which the material appeared
before it was removed or access to it was disabled.
(C) A statement under penalty of perjury that the subscriber has a good
faith belief that the material was removed or disabled as a result of
mistake or misidentification of the material to be removed or disabled.
(D) The subscriberÂs name, address, and telephone number, and a
statement that the subscriber consents to the jurisdiction of Federal
District Court for the judicial district in which the address is
located, or if the subscriberÂs address is outside of the United States,
for any judicial district in which the service provider may be found,
and that the subscriber will accept service of process from the person
who provided notification under subsection (c)(1)(C) or an agent of such
person.
Such written notice should be sent to our designated agent as follows:
Copyright Agent
YouTube, Inc.
PO Box 2053
San Mateo, CA 94401
Email: copyright@youtube.com
Please note that under Section 512(f) of the Copyright Act, any person
who knowingly materially misrepresents that material or activity was
removed or disabled by mistake or misidentification may be subject to
liability. Please also be advised that we enforce a policy that
provides for the termination in appropriate circumstances of subscribers
who are repeat infringers.
Very truly yours,

Maybe can put some up on free tripod pages, but the size would have to be 4k to upload :/
:(
my next question to the ninja will be: How can we kill Youtube.com
thats sad man.
Thats pretty bad, what kind of proof did the person reporting you have to provide?
I bet it was nothing like the shit they are asking of you in this letter.
I smell an assasination in the future, and I won't be missing any of the higherups from youtube. :P

hey how do you donnload / upload em ?
Episode 10. take that 'the man'.
here
That’s one scary e-mail to read for a non ninja. It’s a shame they don't ask for proof of copyright by the person who I can only guess submitted the complaint to them. I guess too that any video that’s flagged as being inappropriate is sent an automated e-mail, maybe they should check the video first beforehand before sending a warning. I have only started using youtube recently after choosing it over google video but after that maybe google video, their arch rivals might be a way to go, I have seen it can do imbedding and it is flash streaming too, though I'm not 100% sure. Ask a ninja is one of the best things I have seen in ages and I am already teaching my dog to walk through walls because of it. May ask a ninja last a 1000 years…
Maybe they saw Google censoring things in China and figured, hmmm, what’s the next best thing we can censor here?
NINJAS.
The show is awesome. Audience of 280,000 and they pull this stunt?
Forget them. Do you really need them since you’re going through iTunes anyway?
my question for the Ninja:
WTF?!...
was youtube.com thinking, do they have evil ninja's working there that don't want us to be informed of the ways of the Ninja. Don't they realize we cannot possibly become a Ninja as we were not born Ninjas. What are they hiding... tacos?

Hey gang, you can use Audioblog.com, upload the video and publish not just the flash video to your OWN blog, and bonus, since you use feedburner, the video is auto-converted to iPod video format that Feedburner will look at and go "HEY, enclosure!"
Our bandwidth is unmetered now and I'll personally sponsor AskANinja for a year with the right storage plan.
I'm travelling at the podcasthotel conference now, but call my office or email me and I'll make sure you get taken care of the best I can.
Cheers,

Since when is humor "inappropriate nature" ?
Perhaps AskANinja should run a caption at the beginning of each video saying
WARNING: This video is dangerously funny. Do not watch it if you
suffer from a lack of humor. You might die.
Apparently YouTube doesn't understand that you will probably be going out to kill them right now while listening to metal and shredding like no other.
Having seen episode 10, I'm baffled. Where's the infringement? I just don't see it. Who flagged the video as objectionable in terms of copyright? I DON'T GET IT.
Where did they get the friggin idea that you are infringing??? On who or what... yourself?
You're one of the most original acts out there...You could make a movie or something.
You got a good lawyer who specializes in intellectual property and media?? or a good agent?
Go knock utube out of the water.
I mean if that Chasidic singing guy can get on David Letterman... you can too. Hey you might even get your own television show.
keep da faith.

My caninja has decided that he will piss on YouTube before he kills them.
Yeah... I told youtubedude (one of the numerous people who posted the Lazy Sunday videos) that YouTube was deleting those videos because NBC didn't want their copyrighted material on there. This is found on http://youtube.com/blog
So youtubedude has posted a video on YouTube about that.
